Photo Competition Terms & Conditions

  1. Norwich Business Improvement District (“NBID”) is working to provide community entrants the opportunity to enter into a prize photo draw for the chance to win one of the prizes (as detailed at clause 12 below) (the “Competition”), subject to the conditions below.

  2. The Prize Competition shall run from [5:00pm] (GMT) on 15 November 2018 until [9.00am] (GMT) on 16 December 2018 (the “Competition Period”). No entries outside of the Competition Period will be accepted.

  3. To submit an entry to the Competition, all fields of the entry form at the following web address www.norwichatchristmas.co.uk must be completed and the completed form must be submitted during the Competition Period (“Valid Entry”).

  4. Anyone under the age of 18 must have their parents’ or guardians’ consent before entering the Competition. Entrants may enter the Competition on behalf of another person but must have the consent of that person, and must ensure that such person consents to these terms and conditions, before entering the Competition.

  5. If an entrant’s photograph features any person or people, other than the entrant themselves, they must obtain the prior consent of those individuals to their being photographed and permission must be obtained from all involved (or their parents’/guardians’ permission if under 18) for their photograph to be submitted in the Competition. If it is clear that the people are not aware of their picture being taken or are embarrassed in any way by any entry NBID receives, NBID will disqualify the entry.

  6. The entrant must be the sole author and owner of the copyright for all images entered. The entrant will retain copyright of the Valid Entry at all times and always be credited alongside the picture. No names will be featured on/or alongside pictures when entries are projected on the castle.

  7. The entrant warrants that any entry submitted to the Competition shall be free from any violent material, pornographic material or activity that is illegal; material which is invasive of a third party’s privacy or includes advertising or marketing material; or material that is harmful, threatening, harassing, offensive or discriminatory.

  8. By entering an image into the Competition, the entrant gives permission for NBID for the exclusive license to reproduce the image for the following purposes:
    A) to be projected onto Norwich Castle on a continuous cycle between 5pm-6pm each evening from 1st December 2018 – 25th December 2018;
    B) to be projected onto Norwich Castle for a continuous period between 5pm and 12pm on Christmas Day and Boxing Day if the image is selected as the winner;
    C) to be shared on a dedicated Instagram feed, which will be accessible by the public to like/share/comment; and
    D) to be streamed on Facebook.
    E) The entrant at the point of entry can elect to be included in local press coverage with our media partner Archant.  Images will be shared with Archant for inclusion in their newspapers, websites and associated print supplements and social media, including and not limited to Norwich Evening News and Eastern Daily Press, Facebook, Twitter and Instagram.

  9. On or before 17 December 2018 NBID shall select a shortlist of 3 entries per category from the Valid Entries received and those Valid Entries on the shortlist shall be publicised (in accordance with clause 13) and made available for a public vote via the EDP website to decide the winner. The public shall submit votes as to whom they think should win the Competition from the shortlisted Valid Entries (“Selection Process”). Such public vote shall close on 20 December 2018.

  10. The Selection Process shall be used to select one winner from the shortlist and (subject to clause 10) the Valid Entry selected shall be the winner of the Competition (being the person with the highest number of votes in the Selection Process).

  11. The winners of the Competition shall be notified by projects@norwichbid.co.uk from NBID. It shall be a condition of the winner claiming their prize that they respond to the notification email within 24 hours of the sending of the notification email. Should any winner not respond during this period or should they be unavailable to attend the prize presentation, NBID shall be entitled to award that winner’s prize to the Valid Entry that registered the next highest number of votes during the Selection Process.

  12. The Competition winners will win the following prizes:

    2nd Prize Winner – BEST Portrait:
    £100 shopping voucher
    2nd prize Winner – BEST Group:
    £100 shopping voucher
    2nd prize Winner – BEST Animal:
    £100 shopping voucher

  13. All prizes must be taken as stated. No prize is transferable. Any winner not electing to accept the prizes as stated shall not be entitled to any cash or other alternative.

  14. All Valid Entries that are selected to form part of the shortlist in accordance with clause 8 shall be made publicly available for the purposes of the Selection Process. As such, it is a condition of entry to the Competition that all entrants agree that their name and photograph (as submitted by the entrant) for the purposes of the Competition shall be made publicly available as part of the Selection Process if their Valid Entry is selected as part of the shortlist. Any person entering the Competition on behalf of another person shall ensure that such person agrees that their name and photograph (as submitted by the entrant) for the purposes of the Competition shall be made publicly available as part of the Selection Process if the entrant’s Valid Entry is selected as part of the shortlist.

  15. Entry to the Competition is deemed as acceptance of these terms and conditions. NBID reserves the right to withdraw the Competition at any time if events or circumstances occur outside its control which makes this necessary.

  16. NBID accepts no liability for any entries that are not completed within the Competition Period due to any reason beyond NBID’s control.

  17. The Competition is not open to employees of NBID, their families or anyone else associated with this prize draw. Any such entries shall be deemed invalid.

  18. The winners of the Competition shall be required to take part in publicity activity and all entrants agree, having gained their parents’ or guardians’ consent if required, to take part in such publicity activity as NBID may require upon reasonable notice without further compensation.

  19. To the maximum extent permitted by law, NBID excludes it liability for any loss, damage, injury, cost or expense suffered by the entrant, whether directly or indirectly and howsoever caused, in connection with the Competition and use of any prize. Nothing in these Terms and Conditions shall exclude NBID’s liability for death or personal injury arising from NBID’s negligence or any other liability that cannot, as a matter of law, be excluded.

  20. By submitting a Valid Entry, the entrant agrees to indemnify NBID and keep NBID indemnified against any loss, damage, injury, cost or expense suffered by NBID as a result of the submission of the entrant’s Valid Entry in the Competition, including (but not limited to) any claim resulting from a breach of these terms and conditions by the entrant, any claim of infringement of intellectual property rights made by any third party or any claim relating to any breach of data protection laws unless NBID shall have processed the relevant personal data otherwise than in accordance with these terms and conditions.

  21. These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes shall be subject to the exclusive jurisdiction of the English Courts.

  22. NBID shall be the data controller for the purposes of any personal data submitted by entrants (as defined by the Data Protection Act 2018) and shall process such personal data only for the purpose of running the Competition in accordance with these terms and conditions any other purpose that the entrant consents to at the point of entry to the Competition. This data shall be retained for the duration of the Competition and erased fully shortly thereafter.
